There are two types of projects: Long Term Projects and Short Term Projects. A "Long Term Project" is any work usage which is ongoing or continuing for an indefinite period of time or exceeds 30 days. A "Short Term Project" is any work usage which is expected to last 30 working days or less. This includes work usage which stems from an emergency situation or which are intermittent in nature.
Prior to committing an inmate work crew to any project, the requesting agency or organization must sign a "Certification of Compliance with KS 75-52, 116" form. KSA 75-52, 116 states:
No work assignment pursuant to this section other than assignments to work for state agencies shall result in the displacement of any currently employed worker or position, including partial displacement such as reduction in the hours of non-overtime work, wages or employment benefits, or result in the impairment of existing contracts for services or collective bargaining agreements. Inmates shall not be utilized to fill a job opening when any individual is on layoff from the same or any substantially equivalent job, and the position remains unfilled. Inmates may not be utilized on a project except to the extent that the cost of the project exceeds the funds available and budgeted for that project. During Fiscal Year 2006, inmates from the Lansing Correctional Facility completed 146,679 hours of community work. This work was completed as long term or short term projects. During this time, there were as many as fifteen work crews working in the community. The crew sizes range from 2-30 inmates per crew depending on the project.
