I. The regularly scheduled meeting of the Kansas State Board of Mortuary Arts (KSBMA) was called to order by President Melissa Wangemann.

in attendance. Assistant Attorney General Camille Nohe was unable to attend the meeting.
Congratulations were extended to board members Bedene, C. Smith and Wangemann as Governor Sebelius notified the KSBMA office on Monday, July 10, 2006 that they had been reappointed to the board for additional three year terms set to expire July 31, 2009.
The board noted this meeting’s tentative agenda that is displayed on the agency’s website at: http://www.kansas.gov/ksbma/ under the heading of Agency Information and Tentative Board Agenda.
(C. Smith-Young) To approve a final agenda for this meeting as amended. Carried.
(Bedene-Holroyd) To adopt the April 13, 2006 regularly scheduled board meeting minutes as amended. Carried. Now that they have been approved by the board, these minutes will be displayed on the board’s website.
The board reviewed results of the written funeral directors’ examination administered on April 13, 2006 noting that 70% (seven of ten applicants) was successful and reviewed information provided by examinees on the “Exit” application from this funeral director examination (which allows an opportunity for applicants to express their thoughts on the examination and examination process.) Responses by the board’s executive secretary were reviewed with no changes noted.
The board reviewed the ‘List of Licensure Applicants’ scheduled to interview with the board at this meeting, noting the following applicants scheduled to meet with the board: two (2) embalmers, seven (7) embalmer-funeral directors, two (2) funeral directors and two (2) reciprocal funeral directors. Three (3) funeral director applicants will be retaking the examination. A total of fourteen (14) applicants are scheduled to be administered the written funeral directors' examination in conjunction with this meeting.
(Bedene-C. Smith) To adopt the KSBMA Report presented at the KFDA Annual Convention on Tuesday, May 2, 2006 at the Wichita Marriott Hotel in Wichita, Kansas. Carried.
The board reviewed all current statutes and regulations under their authority and recommended changes to K.S.A. 65-1751, K.A.R. 63-1-1 and K.A.R. 63-5-1.
Statute changes will require legislation, while regulation changes will require going through the regulation process which includes meeting with the Joint Committee of Administrative Rules and Regulations (JCARR) and a public hearing. The board directed the executive secretary to take the appropriate action necessary to enact the changes to the above-mentioned laws.
The revised Rule Book effective July 1, 2006 was reviewed and discussed. The rule book can be purchased in paper format for $5.00 or can be downloaded at no cost from the agency’s web site.

II. The board considered the following two assistant funeral director applications:
Assistant Funeral Director Applicant: Mr. Duane E. Harvey
Mr. Harvey met with the board to discuss his assistant funeral director application.
Following comments from the applicant, review of the application and all submitted documentation, the board recessed for purposes of deliberate.

(Holroyd-Young) To grant an assistant funeral director license to Mr. Harvey. Carried.
Assistant Funeral Director Applicant: Anthony Milligan
Mr. Milligan met with the board to discuss his assistant funeral director application.
Following comments from the applicant, review of the application and all submitted documentation, the board recessed for purposes of deliberate.
Upon reconvening the board took the following action:
(Smith-Young) To grant an assistant funeral director license to Mr. Milligan. Carried.
(Young-Smith) To recess until 9:00 a.m. on Thursday, July 13, 2006. Carried.
III. The board reconvened and the meeting of the Kansas State Board of Mortuary Arts (KSBMA) was called to order by President Melissa Wangemann.

The board’s Executive Secretary, Mack Smith was in attendance. Assistant Attorney General Camille Nohe was unable to attend the meeting.
The board reviewed individual applications for embalmer and funeral director licensure along with the executive secretary’s summations of the applicant’s apprentice and supervising licensee progress reports. Applicants for licensure will be interviewed later in this meeting. Funeral director applicants will be administered the written funeral directors' examination by Funeral Home Inspector Francis Mills at 1:30 p.m. later this afternoon in the Florentine Room of the Jayhawk Tower.
All quarterly progress reports of embalmer/funeral director apprentices and supervising licensees were summarized by the executive secretary and discussed by the board with copies of the written reports available for review.
The board reviewed the third quarter funeral directing apprentice progress reports and second quarter embalming apprentice progress reports of apprentice Elizabeth Robinson. Following review of the reports the board decided to take no action at this time.
The board reviewed correspondence with apprentice Brooke T. Chadd resulting from action taken at the April 13, 2006 meeting in which the first quarter embalming apprenticeship was denied credit. The apprentice has since changed employment and has decided to drop her embalming apprenticeship at this time but continues to serve a funeral directing apprenticeship.
The board discussed the embalming-funeral directing apprenticeship of Lyle D. Kee. The format for his apprenticeship was previously approved by the board. No additional action was taken at this time.

The Board’s Investigative Committee, which is composed of Board Members
Wangemann and Bedene with legal assistance provided by Assistant Attorney General (litigation) Steve Phillips and administrative assistance by Executive Secretary Smith, met on Wednesday, April 12, 2006 to discuss all open complaints. Investigative Committee recommendations are included with the individual complaints.
#05-30–This individual’s embalmer license was suspended for six (6) months with a public censor due to a conviction of a crime of moral turpitude and failure to indicate such when renewing their license. The suspension was stayed contingent upon earning an additional six hours of continuing education in the area of ethics to be approved by the board’s executive secretary within twelve months (by November 22, 2006.) The licensee has met conditions imposed by the board and is requesting that the board remove their action from her record after three to five years.
(Wangemann-C. Smith) To deny the request of the licensee and close the file. Carried. The individual will be appropriately notified.
#06-03–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on the information provided there are no violations of laws regulated by the KSBMA. The complaint deals with a fraudulent/misleading advertisement.
#06-05–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on the information provided there are no violations of laws regulated by the KSBMA. The licensee was notified that it appears as though better communication could have avoided the situation from occurring. The complaint deals with unprofessional conduct regarding at-need funeral arrangements.
#06-06–(Investigative Committee Motion) To close the file. Carried. The licensee has been notified that based on information provided there are no violations of laws regulated by the KSBMA. The complaint has to do with an advertisement by a family member criticizing actions of the funeral home.
#06-08–(Investigative Committee Motion) To close the file. Carried. The complainant has been notified that based on the information provided there is no violation of laws regulated by the KSBMA. The complaint is not having a licensee in charge of a funeral service.
#06-09–No action necessary at this time.
#06-14–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on information provided there are no violations of laws regulated by the KSBMA. The complaint is inappropriately providing certified copies of the death certificate and charges on an at-need funeral bill regarding unauthorized long distance telephone calls.
#06-15–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on the information provided there are no violations of laws regulated by the KSBMA. The licensee was notified that it appears as though better communication could have avoided the situation from occurring. The complaint involves unprofessional conduct and pricing concerns.
#06-16–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on the information provided there are no violations of laws regulated by the KSBMA. The licensee was notified that it appears as though better communication could have avoided the situation from occurring. The complaint involves unprofessional conduct and at-need pricing concerns.
#06-17–This complaint is being prosecuted by the Office of the Kansas Attorney General. A hearing date of Wednesday, November 8, 2006 at 2:00 p.m. has been scheduled.
#06-18–(Investigative Committee Motion) To close the file. Carried. Both parties have been notified that based on the information provided there are no violations of laws regulated by the KSBMA. The complaint involves unprofessional conduct and pre-financed funeral and cemetery agreements.
#06-19–(Investigative Committee Motion) To adopt the recommendations of the Investigative Committee to notify both parties that based on the information provided there are no violations of laws regulated by the KSBMA. Carried. The complaint involves an overpayment of a prefinanced funeral agreement due to the Estate Recovery Unit of the Division of Health Policy and Finance.
#06-20–(Investigative Committee Motion) To close the file. Carried. The assistant funeral director license application was granted by the board.
#06-21–(Investigative Committee Motion) To close the file. Carried. The assistant funeral director license application was granted by the board.
#06-22–No board action necessary at this time. The Investigative Committee is taking action to determine if violations have occurred.
#06-23–(Investigative Committee Motion) To adopt the recommendations of the Investigative Committee to close the file. Carried. The complaint involves the length of time taken by a doctor to sign a death certificate. The consumer has requested the file to be closed as she claims no wrong doing on behalf of the licensee/funeral home.
#06-24–No board action necessary at this time.
#06-25–(Investigative Committee Motion) To adopt the recommendations of the Investigative Committee to close the file. Carried. The complaint involves advertising of a formerly licensed facility. The advertisement has been corrected.
#06-26–(Investigative Committee Motion) To adopt the recommendations of the Investigative Committee to close the file. Carried. The complaint involves advertising.

#06-28–(Investigative Committee Motion) To adopt the recommendations of the Investigative Committee to notify the licensee that the solicitation is misleading and deceptive. Carried.
#06-29–No board action necessary at this time.
K.A.R. 30-4-98–This is the regulation of the Kansas Department of Social and Rehabilitation Services (SRS) regarding their Funeral Assistance (FA) Program. A similar regulation (KAR 30-4-96) was previously revoked (effective March 7, 2003) when the program was facing the possibility of being transferred to the Kansas Department of Health and Environment (KDHE.) Since that transfer never occurred, K.A.R. 30-4-98 is in the process of being enacted to basically replace K.A.R. 30-4-96. A public hearing for this regulation was held on Friday, July 7, 2006. Formal adoption by the agency is scheduled for Friday, July 14, 2006. The effective date will be published in an upcoming edition of the Kansas Register. As of May 31, 2006, $531,000 has been provided in Funeral Assistance Funds in FY 2006 with one month remaining. Actual expenses in FY 2005 were $552,511. $470,00 was originally budgeted for FY’s 2006 and 2007. The legislature added an additional $100,000 for FY 2006, for a total of $570,000, and $50,000 for FY 2007, for a total of $520,000.
V. Legislative Update
A review of Bills Affecting the Kansas State Board of Mortuary Arts and the funeral profession from the 2005-2006 Legislative Sessions was discussed by the board and included the following legislation:
• Senate Bill 421–Funeral picketing. Despite several different attempts and amendments, this bill died in a conference committee.
• House Bill 2824–Eliminating the five-day waiting period for funeral homes to access prefinanced funeral agreements at-need. The bill became law upon publication in the statute book: July 1, 2006. The bill amends K.S.A. 16-304.
• Funeral Assistance Program of the Kansas Department of Social and Rehabilitation Services (SRS)–FY 2006 funding was increased by $100,000 for a total of $570,000. FY 2007 funding was increased by $50,000 for a total of $520,000.
• Senate Bill 365–Estate taxes eliminated on estates valued at $1 million and less and will gradually phase out estate taxes on all other estates until 2010 when the estate tax will be sunset. Takes effect on January 1, 2007.
• House Bill 2189–KPERS Lump-Sum Death Benefit would have been increased from $4,000 to $5,000. The bill died in committee.
• Senate Bill 530–Would have required that death certificates list the maternal status of a woman along with personal data. This information is already required. The bill died in committee.
• Machinery and Equipment Property Tax Exemption–As of July 1, 2006 there is a property tax exemption for commercial and industrial machinery equipment acquired by qualified purchase or lease.
• Assistant Funeral Directors–No action during the 2005-2006 Legislative Session. At their Spring 2006 District Meetings, the Kansas Funeral Directors Association announced that they will request introduction of legislation in 2007 to require that assistant funeral directors have a high school diploma or the equivalent thereof; earn six hours of continuing education every two-year licensing/renewal period, and for new applicants to pass an open-book written examination over Kansas laws. No additional information known at this time, and the board has not yet seen a copy of the association’s proposed legislation.
VI. Board Interviews with Applicants for Licensure:
Embalmer-Funeral Director Applicant: Mr. Travis W. Farwell
(Bedene-Wangemann) To grant an embalmer license upon completion of apprenticeship and payment of an initial license fee of $161.00 and to grant a funeral director license upon completion of apprenticeship, payment of an initial license fee of $46.00 and passing of the written funeral director examination, which will be administered later today. Carried. Mr. Farwell is scheduled to complete his apprenticeships on August 16, 2006, at Lamb-Roberts Funeral Home in Ottawa, Kansas. Once issued, the renewal date for the licenses would be June 30, 2008. Mr. Farwell attended Allen County Community College in Iola, Kansas, Independence Community College in Independence, Kansas, Haskell Indian Nations University in Lawrence, Kansas and earned an Associate of Applied Science Degree in Mortuary Science at Kansas City Kansas Community College in Kansas City, Kansas.
Embalmer Applicant: Mr. Curtis L. Foley
(Young-Holroyd) To grant an embalmer
license upon payment of an initial
license fee of $168.00. Carried. Mr. Foley completed his apprenticeship
at Day
Funeral Home and Crematory in Wellington, Kansas. He served a portion
of his
apprenticeship at Rumsey-Yost Funeral Home and Crematory in Lawrence,
Kansas. Once issued, the renewal date for the license would be June 30,
2008. Mr. Foley attended Neosho County Community College in Chanute,
Kansas,
Kansas State University in Manhattan, Kansas and earned an Associate of
Applied Science Degree in Mortuary Science at Kansas City Kansas
Community
College in Kansas City, Kansas. Mr. Foley will be administered the
written
funeral director examination later today.
Embalmer-Funeral Director Applicant: Mr. Reed A. Hurkman
(Bedene-Young) To grant an embalmer
license upon payment of an initial
license fee of $182.00 and to grant a funeral director license upon
payment of an
initial license fee of $52.00 and passing of the written funeral
director
examination, which will be administered later today. Carried. Mr.
Hurkman
completed his apprenticeships at D.W. Newcomers Sons Funeral Home in
Overland Park, Kansas. Once issued, the renewal date for the licenses
would
be August 31, 2008. Mr. Hurkman attended the University of
Nebraska-Omaha
in Omaha, Nebraska, Metropolitan Community College in Omaha, Nebraska
and
earned an Associate of Applied Science Degree in Mortuary Science at
Kansas
City Kansas Community College in Kansas City, Kansas.
Embalmer Applicant: Mr. Michael “Mike” S. Kemp
(Bedene-Holroyd) To grant an embalmer
license upon payment of an initial
license fee of $35.00. Carried. Mr. Kemp completed his apprenticeship
at
Russell Funeral Home in Russell, Kansas. Once issued, the renewal date
for the
license would be November 30, 2006. Mr. Kemp earned an Associate of
Applied
Science Degree in Mortuary Science at Arapahoe Community College in
Littleton, Colorado. Mr. Kemp was granted a Kansas funeral director
license in
January 2006.
Embalmer-Funeral Director Applicant: Mr. Phillipe J. Manning
(Wangemann-Holroyd) To grant an embalmer license upon completion of apprenticeship and payment of an initial license fee of $42.00 and to grant a funeral director license upon completion of apprenticeship, payment of an initial license fee of $12.00 and passing of the written funeral director examination, which will be administered later today. Carried. Mr. Manning is scheduled to complete his apprenticeships on August 23, 2006, at Popkess Mortuary in Sabetha, Kansas. Once issued, the renewal date for the licenses would be January 31, 2007. Mr. Manning attended Highland Community College in Highland, Kansas, Washburn University in Topeka, Kansas and earned an Associate of Applied Science Degree in Mortuary Science at Kansas City Kansas Community College in Kansas City, Kansas.
Embalmer-Funeral Director Applicant: Mr. James D. “Lou” Moore
(Bedene-Young) To grant an embalmer license upon payment of an initial license fee of $49.00 and to grant a funeral director license upon payment of an initial license fee of $14.00 and passing of the written funeral director examination, which will be administered later today. Carried. Mr. Moore completed his apprenticeships at White Chapel Funeral Home in Gladstone, Missouri. He served the greater portion of his apprenticeships at Charter Funerals in Merriam, Kansas. Once issued, the renewal date for the licenses would be January 31, 2007. Mr. Moore earned an Associate of Applied Science Degree in Funeral Service at the Commonwealth Institute of Funeral Service in Houston, Texas. He is currently a licensed funeral director in the state of Missouri.

Reciprocal (Oklahoma) Funeral Director Applicant: Mr. David J. Grimaldi
(Bedene-Holroyd) To grant a reciprocal
funeral director license upon payment of
a $50.00 initial license fee and passing the written funeral director
examination,
which will be administered later today. Carried. The renewal date for
the license
would be July 31, 2008. Mr. Grimaldi was licensed as a funeral director
license
in the state of Oklahoma on July 14, 2005. He attended Fort Scott
Community
College in Fort Scott, Kansas, Pittsburg State University in Pittsburg,
Kansas and
earned a Bachelor of Science Degree in Funeral Science at the
University of
Central Oklahoma in Edmond, Oklahoma. He was granted a Kansas
reciprocal
(Oklahoma) embalmer license on April 13, 2006. He is currently employed
at
Bath-Naylor Funeral Home and Crematory in Pittsburg, Kansas.
Reciprocal (Missouri) Funeral Director Applicant: Mr. Todd W. Meierhoffer
(Bedene-C. Smith) To grant a reciprocal funeral director license upon payment of a $66.50 initial license fee and passing the written funeral director examination, which will be administered later today. Carried. The renewal date for the license would be January 31, 2007. Mr. Meierhoffer was granted licensure in the state of Missouri on October 11, 2000. He attended Missouri Western State College in St. Joseph, Missouri and earned a Bachelor of Arts Degree in Business Relations at Westminster College in Fulton, Missouri. He is currently employed at Meierhoffer Funeral Home and Crematory in St. Joseph, Missouri.
Funeral Director Applicant: Ms. Elizabeth J. Oldenettel
(Young-C. Smith) To grant a funeral director license upon completion of apprenticeship, payment of an initial license fee of $16.00 and passing of the written funeral director examination, which will be administered later today. Carried. Ms. Oldenettel is scheduled to completed her apprenticeship on August 13, 2006 at Wichita Mortuary Services in Wichita, Kansas. She served approximately eight months of her apprenticeship at Cochran Mortuary in Wichita, Kansas. Once issued, the renewal date for the license would be March 31, 2007. Ms. Oldenettel earned an Associate of Applied Science Degree at Mid-America College of Funeral Service in Jeffersonville, Indiana. She was granted a Kansas reciprocal (Indiana) embalmer license on July 13, 2005.
Funeral Director Applicant: Ms. Sydney Saltzman
(Young-Bedene) To grant a funeral director license upon payment of an initial license fee of $26.00 and passing of the written funeral director examination, which will be administered later today. Carried. Ms. Saltzman completed her apprenticeship at Chaput-Buoy Funeral Home in Concordia, Kansas. Once issued, the renewal date for the license would be July 31, 2007. Ms. Saltzman attended Cloud County Community College in Concordia, Kansas and earned an Associate of Applied Science Degree at Kansas City Kansas Community College in Kansas City, Kansas. She is currently serving an embalming apprenticeship.
The board recessed for lunch in the Jayhawk Tower Restaurant.
At approximately 1:30 p.m. Executive Secretary Smith read instructions to the funeral director examinee applicants prior to the administration of the funeral director examination which was proctored by Funeral Home Inspector Francis Mills in the Florentine Room of the Jayhawk Tower. The results of that examination are a part of these minutes.
VII. Board Business:
1) (Smith-Young) To approve the quarterly lists of continuing education. Carried. One list contains correspondence/home study programs. Both of these lists of approved continuing education programs are regularly updated and are available on the board’s web site on the internet and are mailed to licensees not having internet access on a quarterly basis. A new feature on the agency’s web site now lists the dates programs have been added, so licensees can determine which programs are new to the list.
2) (Bedene-C. Smith) To approve the list of lapsed licenses as amended. Carried. The list is a part of these minutes and contains the names of individuals whose license renewals are past due for longer than six months or who have requested that their licenses be dropped. Licensees who have died during the past quarter are also included on this list for informational purposes.
3) The board reviewed the list of automatically suspended licenses. This list contains the names of individuals who have not paid their license renewal fees by the appropriate due date and have not requested that their licenses be dropped. Once a license is six months in arrears, it is then automatically placed on the lapsed license list for purposes of being dropped.
4) (C.Smith-Young) To approve the FY 2006 fourth quarter (April 1-June 30, 2006) and FY 2006 Final (July 1, 2005–June 30, 2006) Inspection Reports of the Funeral Home/Crematory Inspector, Francis F. Mills. Carried.
5) Reviewed the current roster of apprentice embalmers and funeral directors. A total of 39 apprentices are currently registered with the board.
6) Discussion of news articles relating to the funeral profession that have been provided to board members and legal counsel for their review.
7) Reminder of the remaining 2006 Board meeting date: October 12.
8) The board approved the following meeting dates for 2007: January 11, April 12, July 12 and October 11. Administrative Staff will make appropriate reservations before these dates are finalized. The board discussed the possibility of reserving a block of hotel rooms at the state rate for applicants, but decided to simply supply a list of hotels in the Topeka area to the applicants prior to scheduled meeting dates.
9) The board signed travel vouchers and licenses.

a) The Board reviewed their policy regarding the Posting of Board Actions to the Board’s Web Site approved at the April 13, 2006 meeting.
VIII. Executive Secretary's Report:
1) Budget Update
a) Information regarding Administrative Salaries for classified and unclassified state employees was reviewed and discussed.
b) The KSBMA spent approximately $219,139 in FY 2006. The budget limitation for FY 2006 was $254,053, so there was an approximate savings of $34,904. $17,452 or half of that savings, will be placed in the agency’s Kansas Savings Incentive Program (KSIP), while the remaining funds will be placed in the agency’s fee fund.
c) The KSBMA’s FY 2007 budget approved by Legislature, Governor and Finance Council totals $265,633 ($261,580 from section seven on page six of Senate Substitute for House Bill Number 2968 plus $4,053 approved by the State Finance Council on June 20, 2006) which includes monies for a salary increase for the administrative staff. The approved budget for FY 2007 includes the cost of replacing the agency’s only vehicle ($12,500.) The process for replacing the vehicle should be in place in the near future.
d) FY 2008-2009 Budget Process–Budgets must be submitted by state agencies to the Division of the Budget by September 15, 2006. The board directed the executive secretary to prepare the agency’s budget and to provide copies for review at the October 2006 meeting.
2) Updated information regarding the International Conference of Funeral Service Examining Boards (ICFSEB.)
a) The 2006-2007 Professional Directory was reviewed.
b) Disciplinary Database–The database was reviewed and discussed. It is in the process of completion with five states (Kansas, Louisiana, North Dakota, Oklahoma and Texas) currently participating.
3) Updated information on the Council on Licensure, Enforcement and Regulation (CLEAR) was discussed.
a) Due to a scheduling conflict, Mr. Smith will not attend the Annual Conference to be held in September 2006.
4) Updated information regarding the Federation of Associations of Regulatory Boards (FARB.)
a) The agency will not be sending a representative to the Attorney Certification Program this year.
5) Updated information on the Kansas Funeral Directors and Embalmers Association (KFDA.)
a) The board reviewed Mr. Smith’s report of the Annual Convention held in May 2006.
b) Mr. Smith will represent the board at the Fall 2006 district meetings.
6) Information on the board’s Web Site, located at: http://www.Kansas.gov/ksbma/, continues to be updated on a regular basis.
7) The board discussed information from the National Funeral Directors Association (NFDA) including:
a) The 2006 NFDA Public Policy Positions was discussed.
b) “When Service Satisfaction Sours” (a three-part article with parts one and two currently released from the May and June 2006 editions of The Director) was discussed. Part three will be included with the July 2006 edition.
8) The board discussed the Federal Trade Commission’s (FTC) Funeral Rule and the possibility of future revisions.
9) Updated information for the American Board of Funeral Service Education (ABFSE.)
10) Updated information from the Cremation Society of North America (CANA.)
11) Updated information from the Funeral Ethics Association (FEA.)
12) Updated information from the Funeral Consumer Alliance (FCA.)
a) The Spring 2006 Newsletter was discussed including an article regarding consumer membership on funeral regulatory boards.
13) Updated information from the Funeral Consumer’s Alliance of Greater Kansas City.
