Affinity Programs |

| Kansas licensees should be aware that programs which are legal in some states may not be legal in Kansas. Before participating in any kind of promotional program, check out its legality in Kansas. Does the program provide for a rebate to a principal in a real estate transaction? An "affinity" program may provide for a rebate. A Kansas licensee may not "accept, give or charge any rebate or undisclosed commission." Furthermore, a Kansas licensee may not pay a referral fee to a person licensed in another jurisdiction if the licensee knows that the payment of the referral fee will result in the payment of a rebate by the out-of-state licensee.
