Title Contracts for information processing equipment, programs, systems or maintenance thereon; approval; specifications for bids, review, exception.

(a) No state agency, as defined in K.S.A. 75-3701 and amendments thereto, shall lease, cause to be leased, purchase, contract for, issue a letter of intent to contract for or cause to be installed, any information processing equipment, including auxiliary equipment or any information processing programs or systems, or maintenance thereon without the prior approval of the Kansas information resources council or specific legislative authorization. The director of accounts and reports shall not issue any warrant in payment for any lease or purchase contract for any information processing equipment, programs and systems acquired without such prior approval or authorization.

(b) All specifications for bids for acquisition of the information processing equipment, including auxiliary equipment and information processing programs and systems, or maintenance thereof shall be reviewed by the chief information architect, under the supervision of the Kansas information resources council. This subsection shall not apply to the information network of Kansas. Title Contracts by state agencies for purchase, transfer and lease back of information processing equipment; approval.

Notwithstanding the provisions of K.S.A. 75-3738 and 75-3739 and amendments thereto, state agencies using information processing equipment under lease are hereby authorized to enter into contracts with leasing service companies for purchase by the agency of such equipment with nonstate funds furnished by such leasing service companies and transfer of title to such equipment by the agency to such leasing service company for lease back to the agency. Any such contract shall first be approved by the chief information architect under the supervision of the Kansas information resources council. Statute # 75-4740 Chapter 75.--STATE DEPARTMENTS; PUBLIC OFFICERS AND EMPLOYEES Article 47.--INFORMATION SYSTEMS AND COMMUNICATIONS
Title Kansas information resources council; membership, terms, chairperson and meetings; members may not appoint representatives; members not eligible for compensation or expense allowances, exceptions.

(a) There is hereby established the Kansas information resources council which shall be attached to the department of administration for purposes of administrative functions.

(b) The council shall be composed of 20 members as follows: The secretary of administration; the secretary of health and environment; the secretary of human resources; the secretary of revenue; the secretary of social and rehabilitation services; the secretary of transportation; the judicial administrator of the Kansas supreme court; the executive director of the Kansas board of regents; the chairperson of the joint committee on computers and telecommunications; the commissioner of education; four additional chief administrative officers of various state agencies; and three representatives from the private sector, the chief information architect and the director of the budget to serve as advisory, nonvoting members. In addition, during those periods of time when the chairperson of the joint committee on computers and telecommunications is a member of the senate, one member of the council shall be a member of the house of representatives appointed by the chairperson of the committee on appropriations of the house of representatives and during those periods of time when the chairperson of the joint committee on computers and telecommunications is a member of the house of representatives, one member of the council shall be a member of the senate appointed by the chairperson of the committee on ways and means of the senate. The four chief administrative officers and representatives from the private sector shall be appointed by the governor for a term not to exceed 18 months. Members, other than members appointed to the council, shall be permanent members on the council. Upon expiration of a member's term, the member shall continue to hold office until the appointment of a successor.

(c) The secretary of administration shall serve as the interim chairperson until such time as a permanent chair is determined by the council.

(d) The council shall hold meetings and hearings in the city of Topeka or at such times and places as it designates, on call of the chairperson or on request of four or more members.

(e) Members of the council may not appoint an individual to represent them on the council.

(f) Members of the council shall not be eligible for compensation, subsistence allowances, mileage or other expenses as provided in K.S.A. 75-3223 and amendments thereto for attendance at any meeting of the council or any subcommittee meeting authorized by the council, except that (1) agencies may pay subsistence, mileage and other expenses to their representatives on the council, and (2) legislators serving as members of the council shall receive compensation and travel expenses and subsistence expenses or allowances as provided by K.S.A. 75-3212 and amendments thereto. Statute # 75-4741 Chapter 75.--STATE DEPARTMENTS; PUBLIC OFFICERS AND EMPLOYEES Article 47.--INFORMATION SYSTEMS AND COMMUNICATIONS

(a) The council is hereby authorized to adopt such policies and rules and regulations as necessary to implement, administer and enforce the provisions of this act.

(b) The council shall:

(1) Approve the policies for the management of the state's information resources, including the strategic information management plan;

(2) provide direction and coordination for the application of the state's information resources;

(3) approve major information technology and telecommunications projects and provide authorization to proceed with the program plans at specific points of completion;

(4) designate the ownership of information resource processes and the lead agency implementation of new technologies;

(5) monitor the return on investment for information resources used within the state;

(6) develop and adopt a strategic information plan;

(7) prescribe guidelines, standards, policies and procedures for advance planning documents for acquisition of information processing equipment, information processing products or services, or any combination thereof; and

There is hereby established, within and as a part of the department of administration, an office of the chief information architect, the head of which shall be the chief information architect. Under the supervision of the Kansas information resources council, the chief information architect shall administer the office of the chief information architect. The chief information architect shall be in the unclassified service under the Kansas civil service act and shall be appointed by the Kansas information resources council. The chief information architect shall:

(c) serve as secretary to the Kansas information resources council;

(e) coordinate implementation of new computer and telecommunication technologies;

(f) coordinate the integration of the state strategic plan and business processes and information technology where appropriate;

(g) audit compliance with infrastructure standards and review findings with the organization for appropriate action; and

Statute # 75-4744 Chapter 75.--STATE DEPARTMENTS; PUBLIC OFFICERS AND EMPLOYEES Article 47.--INFORMATION SYSTEMS AND COMMUNICATIONS
Title Chief information architect to review information processing budget requests of agencies; recommendations to division of budget; factors to be considered.

The chief information architect, under the supervision of the Kansas information resources council, shall review the information processing budget requests submitted by all divisions, departments and agencies annually and submit recommendations to the division of the budget as to the technical and management merit of the requests. In making such recommendations the chief information architect shall consider the following factors:

(a) Whether the request is consistent with the comprehensive plan approved by the Kansas information resources council; (b) whether the request is consistent with present and future needs of the state; (c) the current ability of the state or agency thereof to meet the system demands intended to be satisfied by the request; (d) the reasonably foreseeable future demands on the current system, if any, affected by the request; (e) the economic benefits or adverse impact of recommending the request; (f) alternate methods of meeting the system demands intended to be satisfied by the request; (g) the adequacy of the plan for integration of the requested project into the current system; (h) the availability of resources necessary to finance the request; and (i) such other factors as the chief information architect deems relevant. Executive Order No. 95-180
Establishing the Kansas Geographic Information Systems Policy Board

Notice/Executive Order

WHEREAS, Article 1, Section 3 of the Constitution of the State of Kansas vests the supreme executive power of the State in the Governor; and WHEREAS, Article 1, Section 4 of the Constitution of the State of Kansas vests in the Governor, the power to require information from the officers of the executive department, upon any subject related to their duties; and WHEREAS, Kansas state government is a complex combination of organizations and functions providing a wide variety of services to citizens and other customers; and

WHEREAS, there is a recognized need to increase quality and lower cost of services provided to Kansas citizens through informed application of geographic information systems technology; and

WHEREAS, improved coordination of the State's geographic information systems resources and development of an infrastructure that promotes efficient service delivery and data sharing among state organizations and government entities is an essential element in improving the quality of services provided to the people of Kansas now and into the next century;

NOW THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby establish the Kansas Geographic Information Systems Policy Board.

(1) The Kansas Geographic Information Systems Policy Board shall:

(1) (a) Establish a strategic management plan to guide the development and implementation of geographic information systems technology for the best value and benefit of the citizens of Kansas and update the plan biennially;

(1) (b) Develop and maintain policies, standards, guidelines, and strategies which emphasize cooperation and coordination among agencies, organizations, and government entities developing and implementing geographic information systems in order to maximize the cost effectiveness of geographic information systems and their value to the State;

(1) (c) Establish public and private partnerships throughout Kansas to maximize value, minimize cost, and avoid redundant activities in the development and implementation of geographic information systems; and

(1) (d) Coordinate, review, and provide recommendations on geographic information systems programs and investments and provide assistance with dispute resolution among geographic information systems partners.

(2) The Kansas Geographic Information Systems Policy Board shall be administratively established as a permanent standing committee of the Kansas Information Resources Council. The Board shall provide an annual report of its activities to the Council, and shall coordinate its activities with those of the Council.

(3) The Board shall consist of 22 members as follows:

(3) (a) The Chief Information Architect of the Kansas Information Resources Council shall be a permanent, voting member of the Board.

(3) (b) Eight voting members of the Board shall be appointed by official commission of appointment of the Governor, certified by and filed with the Secretary of State, to represent the following:

(i) The Secretary of the Department of Agriculture;

(ii) The Chairperson of the Kansas Corporation Commission;

(iii) The Director of the Kansas Water Office;

(iv) The Secretary of the Department of Health and Environment;

(v) The Secretary of the Department of Revenue;

(vi) The Secretary of the Department of Transportation;

(vii) The Executive Director of the State Conservation Commission; and

(viii) The Secretary of the Department of Wildlife and Parks.

(3) Each of these members shall be a senior level manager who has a comprehensive understanding of the agency's overall information needs. Two members shall be appointed for a term of two years, three for a term of three years and three for a term of four years, and thereafter, upon the expiration of each initial term, the successor member shall be appointed for a term of four years.

(1) (c) Five voting seats of the Board shall be filled with representatives of county and municipal governments by official commission of appointment of the Governor, certified by and filed with the Secretary of State. At least two of the five members shall represent counties and at least two shall represent municipal governments. Of the five members, one shall be appointed for a term of two years, two shall be appointed for a term of three years, and two for a term of four years, and thereafter, upon the expiration of each initial term, the successor member shall be appointed for a four-year term.

(1) (d) Three voting members of the Board shall be representatives from Board of Regents institutions appointed by official commission of appointment of the Governor, certified by and filed with the Secretary of State. One member shall be appointed for a term of two years, one for a term of three years and one for a term of four years, and thereafter, upon the expiration of each initial term, the successor member shall be appointed for a term of four years.

(1) (e) In addition to the above members, five ex officio, non-voting seats of the Board shall be filled by official commission by appointment of the Governor, certified by and filed with the Secretary of State, allocated as follows:

(1) (i) Two seats shall be filled by executive level representatives from the private sector.

(1) (ii) Two seats shall be filled by executive level representatives of two federal agencies with offices in Kansas.

(1) (iii) One seat shall be filled from a state-wide organization designated by the Governor.

(1) Of these five seats, one member shall be appointed for a term of two years, two for a term of three years, and two for a term of four years, and thereafter, upon the expiration of each initial term, the successor member shall be appointed for a term of four years.

Executive Order

(4) Notwithstanding the designation of membership terms, the Governor may remove members from the Board, with or without cause or hearing.

(5) The Chairperson and Vice Chairperson of the Board shall be appointed by the Governor by official commission of appointment of the Governor, certified by and filed with the Secretary of State, and shall serve at the pleasure of the Governor. The Board may elect other officers from among its members and may establish any committees that are deemed necessary to discharge its duties.

(6) Members of the Board shall not receive compensation, subsistence allowance, mileage or associated expenses. Officers or employees of state agencies who are appointed to the Board shall be authorized to participate on the Board as part of their duties and may claim subsistence allowance, mileage or associated expenses as permitted by law.

(7) For administrative purposes the Board shall be housed in the Kansas Water Office. The Board shall receive staff support from the State Geographic Information Systems Coordinator.

(8) The Board shall work jointly with officials from other state agencies, organizations, and county and municipal governments, as well as officials from private sector organizations who are concerned with the efficient management of the State's geographic information systems resources.

This order shall continue in full force and in effect until the date of any subsequent Executive Order with respect to the subject hereof is promulgated.

This document shall be filed with the Secretary of State as Executive Order No. 95-180 and shall become effective immediately.

SUBJECT: KANSAS STRATEGIC INFORMATION MANAGEMENT PLAN PROJECT

The Kansas Information Resources Council has initiated a project to produce a Strategic Information Management Plan for the state government. The Plan will be approved by the Council, and will be completed by January 1, 1997.

The Kansas Legislature assigned responsibility to the Council to approve a Strategic Information Management Plan for the state government. Council membership consists of the heads of the major agencies in the Executive branch of government, House and Senate representatives from the Legislative branch, a representative from the Judicial branch, the Executive Director of the Board of Regents, and private industry executives. The Council provides the central point of leadership, coordination, and general management for information technology in state government.

The Chief Information Architect, a member of the Council, is responsible for the project to produce the Plan. The Ken Orr Institute, a consulting organization based in Topeka, has been selected to conduct the project.

Objectives for the Strategic Information Management Plan include:

Ž Clearly define the goals and objectives for information, and information technology (IT), in the three branches of government.

Ž State the principles applicable to IT management, service delivery, and policy issues.

Ž Convey the roles and responsibilities of all applicable parties regarding IT management and service delivery.

Ž Contribute to improved use and alignment of technology in support of agency program objectives and performance measures.

Ž Support multi-agency coordinated public services.

Ž Enable coordinated support of technology-related public issues.

Ž Serve to raise the quality of technology services available to agencies.

In development of the Plan, the consultant will engage members of the Kansas Information Resources Council, individual agencies, and several groups representing agencies throughout the state. Consensus will be sought among the many groups and agencies involved in Plan development. The final Plan will be approved by the Council.
