The first six pages, 71-5-1 through 71-5-6 are administrative and deal with the revocation of the existing regulations.

The remainder of the regulations are:

71-5-7.  Definitions.  Defines critical terms used in the regulation, including anxiolysis, conscious sedation, deep sedation and definitions using the terms enteral and parenteral.

71-5-8.  Applicability.  All treatment settings except medical care facilities.

71-5-9.  General Requirements. Covers information including:
            -  No permit required for the use of nitrous oxide and oxygen  whether alone, with local anesthetic or with anxiolytic agent.  Anxiolysis is defined in 71-5-7 as the diminution or elimination of anxiety and clearly states that there is no depression of consciousness at all.
            -  Nitrous oxide oxygen equipment must have an operational mechanism that ensures delivery of not less than 25 percent oxygen to the patient.
            -  Training requirements, in addition to the appropriate level permit, required for the use of sedative agents with patients 12 years of age or younger.
            -  Information pertaining to the administration of sedative agents by other persons (besides dentists) who are so authorized by Kansas law.
            -  Required written reporting of morbidity and mortality related to sedation within 30 days.

71-5-10.  Level I permit:  enteral conscious sedation or combination inhalation-enteral conscious sedation.  Covers training, experience and application requirements for initial permit and renewal of permit, trained personnel, equipment and documentation requirements.

71-5-11.  Level II permit:  parenteral conscious sedation.  Covers training, experience and application requirements for initial permit and renewal of permit, trained personnel, equipment and documentation requirements.

71-5-12.  Level III permit:  deep sedation and general anesthesia.  Covers training, experience and application requirements for initial permit and renewal of permit, trained personnel, equipment and documentation requirements.

71-5-13.  Grounds for refusal to issue permit or for revocation, suspension, or limitation of permit.
