Commitment to Unbiased Law Enforcement - Racial Profiling Prohibited
It is the policy of the Kansas Bureau of Investigation (KBI) to treat all persons having
contact with this agency in a fair, equitable and objective manner, in accordance with the
law and without consideration of their race, color, national origin or other individual
characteristics. KBI commissioned employees are prohibited from initiating law
enforcement action against any person based solely on a person's race, ethnic
background, gender, sexual orientation or religion.
Kansas law (K.S.A. 22-4606 through K.S.A. 22-4611) prohibits the practice of racial
profiling by any law enforcement officer.
"Racial Profiling" means the practice of a law enforcement officer or agency relying,
as the sole factor, on race, ethnicity, national origin, gender, or religious dress in
selecting which individuals to subject to routine investigatory activities, or in
deciding upon the scope and substance of law enforcement activities following the
initial routine investigatory activity. Racial profiling does not include reliance on such
criteria in combination with identifying factors when the law enforcement officer or
agency is seeking to apprehend a specific suspect whose race, ethnicity, national
origin, gender or religious dress is part of the description of the suspect.
If you believe that you have been the subject of racial profiling as defined above, you
may make a complaint to the agency that employs the officer(s) involved or you may
make a complaint to the Kansas Human Rights Commission.
If you believe that you have been the subject of racial profiling by an agent of the KBI
you may make a complaint to either the KBI or the Kansas Human Rights Commission.
Any complaint alleging racial profiling made against an employee of the KBI should be
made in writing and sent to the office of the associate director. The complaint should
describe in detail the incident giving rise to the complaint. The complaint should include
the date, time, location and identity of the KBI personnel (if known). The complaint
must be signed and include the name, address, phone number or other contact
information for the person who was the subject of the law enforcement action.
All complaints alleging racial profiling on the part of a KBI agent will be thoroughly and
aggressively investigated. Violations of KBI policy prohibiting racial profiling will result
in disciplinary action against the involved employee(s).
